Transportation Projects
Dulles Metrorail Extension, Virginia – 1999 until 2008. The Project will extend the Washington Metro to Dulles International Airport and into Loudoun County. It includes a 22-mile, 11-station, Metrorail extension that would also service Tyson’s Corner.
- Project Development Phase - In 2000, helped form a special-purpose entity called Dulles Transit Partners (DTP) to enter into project agreements with Virginia. Co-lead negotiator for DTP in 2004 of a $65M Comprehensive Agreement (CA) including preliminary engineering, development and finance planning.
- Design-Build Contract –Co-lead negotiator for DTP for the $1.7B Design-Build Contract for the first phase of the project. Negotiate critical issues, including bonding required, limits of liability, liquidated damages provisions, use of allowances for undefined work, savings provisions, dispute resolution and escalation provisions for DB contract.
Georgia Toll Road Projects – 2004 through 2008, led two private consortium negotiations teams for Washington Group on two proposals for toll-financed projects in Georgia under the recently enacted Public Private Statute: 30-mile SR316 expansion and reconstruction to provide for grade separated intersections and additional capacity lanes valued at $800 million and additional safety features; and the Ga400 tolling and expansion project, valued over $1.6 billion and involved tolling of a commuter corridor. Successfully led negotiations of the first full set of development agreements GDOT.
High Speed Rail, Special Purpose Company – Co-Managing Director for a U.S. entity formed to pursue the high speed rail system on behalf of Asian turnkey rail company. Assisted in building multidisciplinary project team, selection of project counsel and preparation of teaming agreements.
Denver RTD Eagle P3 Project – Selected as part of a panel which included international experts in public private partnerships conducted a peer review of the procurement strategy and approach and the contract documents on behalf of the Agency’s Board prior to the final submission of proposals on this landmark project for the transit industry in the US.
Hudson-Bergen Light Rail Transit System, New Jersey 1999 to 2003 – At $1.8 billion, it was the largest public works contract ever issued in New Jersey and the first Design-Build-Operate-Maintain (DBOM) project. Corporate Secretary of the 21st Century Rail Corporation, managed contract matters; supported negotiation of collective bargaining agreement with transit union; resolved issues involving operating, insurance and liability issues with New Jersey Transit. Oversaw contract administration and changes, including the addition of a $500 million extension to the Project.
Stamford Streetcar Feasibility Study – Participated in a feasibility study for the City of Stamford, Conn. for putting a streetcar into their main business and residential corridor to stimulate economic development. Assisted in the work tasks on funding strategy and consensus building which resulted in a pre-development analysis indicating financial capacity of a value capture strategy.
Houston METRO Light Rail Program, Houston Texas – lead negotiator for the $75M Facility Provider Agreement (FPA) for development of the $2 billion new light rail systems, which was negotiated in a period of 4 months. The FPA outlined the framework for project delivery approach. As lead negotiator, coordinated the efforts of the remediation, finance, design, development, construction and operations members of the team and worked closely with Metro’s lead negotiators and outside counsel.
Municipal Airport Contracted Operations Agreements, Texas – Assisted in drafting and negotiating 35 year operating agreement between city in Texas and private joint venture for operations and management of city owned general aviation airport. Negotiated the joint venture agreement between contractor and local real estate developer to perform the operating contract.
Jordanian Railroad, Privatization Agreements, Country of Jordan - Represented private sector company in consortium for international partnership and for privatization concession for Jordanian Freight Railroad system with the country of Jordan. Project involved responsibility for the existing national railroad and an expansion of the line to transport phosphates from a mines and fertilizer to the Port of Aqaba. Completed Transportation, EPC, O&M and Concession Agreements.
Seminole County Expressway Authority, Toll Road Extension Project - Provided procurement advisory services to the public toll authority in Seminole County, Florida and drafted revisions to bidding, specifications and contractual documents for extension of the tolled highway surrounding the greater Orlando area.
Utilities and Facilities
New Orleans Permanent FLOOD CONTROL Project, Project Counsel – Provided government contracts, procurement, subcontracting and compliance counseling to E&C contractor in proposal effort for one of Corps of Engineer’s several hundred million dollar design-build project for post-Katrina flood control system.
Sierra Pacific Power Company, Pinon Pine Integrated Gasification Combined Cycle Project - Provided procurement advisory services for seven years to Nevada utility in developing and negotiating contract documents, dispute resolution mechanisms, contract risk allocation, and contracting strategy for $300 million project which was part a DOE’s Clean Coal Technology program. Assisted in successful resolution of $40 million in contract issues.
Orlando Utilities Commission, C.H. Stanton Energy Project, Unit 2 - Provided procurement advisory services and coordinated preparation of procurement documents with A/E for $500 million design and construction of Unit 2 of a Florida coal fired power plant, including introducing the use of partnering and dispute review board.
Kissimmee Utilities Authority, 160MW CT-Combined Cycle, Cane Island Project - Provided owner’s representative and procurement advisory services for combustion turbine, combined cycle project for Florida municipal utility. Implemented team building workshops, improved contract risk allocations and multi-stepped collaborative dispute resolution.
Orlando Utilities Commissions, Waste Water Treatment Plants Contract Development - Assisted Municipal Water Commission in central Florida and their engineering consultant in preparing innovative Engineer, Procure and Construction Management (EPCM) Contract for fast track construction of a state of the art water treatment systems.
Sierra Pacific Power Company, Alturus Transmission Line Construction Agreements - Assisted Sierra Pacific Power Company in developing and procuring design and construction agreements for 400 mile major transmission line through Nevada and northern California.
Tampa Electric Company, Polk County Coal Gasification, Combined Cycle Project - Provided third party neutral fact finding and procurement evaluation services for schedule, design and cost issues for $300 million clean coal technology project.
Carrilion Health Systems, Mary Washington and Roanoke Memorial Hospitals – Provided hospital owner with advice on contract delivery approaches including use of CM at risk, design-build and pre-construction services for hospital expansion and new construction.
Harrisburg Cogeneration Project, Design-Build Contracts, Pennsylvania - Worked with private developer, design/build contractor, and designer in preparing a full set of bidding and contract documents for a cogeneration/district-heating project in state capitol to install two diesel generating units and steam production boilers. Project was successfully completed in 1985.
